One Arrest - Three Cases
An arrest for DWI / DUI carries significant consequences and requires
that you take immediate action to protect your rights. If you
failed or refused a blood / breath test, the government has already started
proceedings to suspend your driver's license.
A single DWI arrest may lead to three
cases in three separate and distinct judicial forums. These include:
(a) the criminal charge which will be litigated in the criminal court;
(b) the administrative license revocation (ALR) proceeding wherein the
state will attempt to take away your driver's license; and (c) a civil
proceeding initiated by you to obtain an occupational driver's license
which will allow you to drive to and from work, school and in the
performance of necessary household duties during the period of
suspension. Each of these is discussed in greater detail.
Do Not Assume Your Case

Following a DWI arrest, you
may be confused, frightened and intimated by the process. This is
normal. You should not, however, assume your case is hopeless. A
careful investigation of the circumstances surrounding the basis for the
stop, administration and scoring of field sobriety tests may reveal
defects in the government's case. It is not unusual for a completely
sober person to fail a roadside balance test. Additionally, the devices
and procedures used to analyze breath, blood and urine are subject to
challenge.
